Shipping

Wine is not shipped immediately. An estimated shipping date will be provided after purchase. Please note that we monitor weather patterns in order to safeguard wine quality. If you have any timing pressure (e.g. wine for gifts or special events), please contact us via email or telephone to let us know.

The purchaser is responsible for shipping costs. The purchaser must be of legal drinking age and an adult of legal drinking age must sign for delivery. We recommend the purchaser provides a business address for shipping to ensure an available signatory. If a shipment fails to be delivered and is returned, we will charge the card used on the order for the reshipment fee. Please note Dutch Canyon LLC cannot be held liable for delayed delivery.

Refunds

Your purchase of Heimark Vineyard wine is non-refundable. Please contact us immediately by email or telephone if there is any damage during shipping.

How the List Works

Heimark Vineyard wine is available in small quantities on an invitation basis. An invitation does not ensure ongoing availability given limited inventories. Wine is available on a first-come, first-served basis.

Allocations to list members will be prioritized based on customer loyalty. If you decide not to purchase wine that is offered in a given year, your future allocation may be lowered. Through this process of actively managing the list, we are making room for new buyers to try the wine. List allocations will also vary based on the size of each year’s vintage.

We reserve the right to refuse service to any buyer for any reason and to set allocations at our discretion. We take List seniority and customer loyalty seriously and make every attempt to be fair.

Reselling the Wine

If we deem that a customer is taking advantage of the amount of wine offered, we are likely to decrease the allocation and/or remove them from the List. Given limited quantities, we have adopted this policy in order to ensure that we can share with those who enjoy fine wine.

Visits

We are unable to accommodate visitors. We are a boutique Napa estate with remarkable vines located on a private road, not a large-scale production facility open to the general public.

Restrictions

Heimark Vineyard wine is only available to adults of legal drinking age and sold for personal consumption. An adult signature is required for delivery of alcoholic beverages.

We only permit shipping to states and countries where Heimark Vineyard has a valid shipping license. Due to the ever-changing nature of wine shipping laws, we may not be able to ship to your location. If Heimark Vineyard is unable to ship, we will work with you to arrange potential alternatives, such as direct pick-up or third-party shipping. Please note that when dealing through a third-party shipper, shipping costs may differ and California sales tax will apply (for which the purchaser will be liable).

If we are unable to find a way to share our product or are concerned that shipping may impair quality, we reserve the right to cancel your order.

Privacy

Heimark Vineyard will make every effort to protect private information. Our website uses state-of-the-art encryption; no one within our company has access to your password or banking details.

We use your website account information to fulfill your orders and to enable time-saving features for future purchases. We do not, under any circumstances, sell your information. We do not contribute to or participate in shared or cooperative databases, which give other companies access to your personal information. In the event that the winery were to be transferred to a third-party buyer, your information may transfer to ensure continued communication. We will contact if you such transfer occurs.

All transactional information is encrypted. Cookies ensure web browsing quality.

Applicable Law

This site is created and maintained by Dutch Canyon LLC, in the State of California, USA. The laws of the State of California govern these disclaimers, terms and conditions. Dutch Canyon LLC reserves the right to update the site or revise terms at any time. Your use of this site indicates your agreement with these Terms and Conditions. The terms “Heimark Vineyard”, “our” and “we” refer to the owner of the website. The terms “you”, the “purchaser”, and “customer” refer to the user or viewer of our website or customer of the product. We have no liability arising out of or in connection with your use of this site. You acknowledge and agree that your use of this site is at your sole risk.

Errors or Omissions

While we make every effort to maintain this site, errors or omissions may occur. We reserve the right to correct errors or omissions without notice and to cancel any offered product or service in the event of an error or omission.

Trademarks

Heimark Vineyard trademarks, brand design, custom graphics, and photographs are protected by Dutch Canyon, LLC. You may not replicate the logos, trademarks, photos, or any other aspect of the design or website without prior written permission from Dutch Canyon, LLC. Misuse is grounds for legal action.
